REGULAR TOWN BOARD MEETING
KILDARE TOWN HALL
August 12, 2009

Present: Chairman Dennis Franek; Supervisors Leo Schneider and Dave Singer; Treasurer Patty Schluter; Clerk Beth Onofrio, 6 citizens: Linda Winterstein, Dan Lapp, Penny Arens, Jim Hagen & Blanche Russ, Tom Guyse; and 1 guest Bruce Holsclaw of Juneau County Emergency Management.

The meeting was called to order by Chairman Franek at 7:04 P.M. in the Kildare Town Hall.

Written minutes of the July 8, 2009 Regular Town Board Meeting were read by the clerk. Motion by Schneider to approve the minutes as corrected, second by Singer; carried by a voice vote of 3 ayes.

Treasurer's report was given by Schluter. Checking Account balance is $151,491.76; Savings -$5.00; Certificate of Deposit -$41,616.53; Contingency Fund -$5000. There were no corrections. Motion by Schneider to enter the Treasurer's Report into the official minutes; second by Franek; carried by a voice vote of 3 ayes.

Reports:

Ambulance Report:
Dan Lapp reported from the July 21 meeting; there were no ambulance calls for Kildare; and land anticipated for the new building was contaminated so the search continues.

Supervisors' Reports:

Dave Singer attended the WTA meeting on 7/26—Senator Schultz and Rep. Brooks discussed increased tipping fees to prevent out of state dumping and the Rural Broadband issue.

Dennis Franek reported that culvert work on 55th Street is being held up by DNR paperwork.

 

Public Comments: Linda Winterstein asked a board member to speak with Bob Marshall about a stack of tires in front of his property; Chairman Franek will do so.  Jim Hagen spoke to workers at the Ho-Chunk prairie property off of Rusty Rd. who told him the prairie is open to the public. Blanche Russ reported a missing ATV sign on Rusty Rd & Cty Rd N and also questioned why recycling is picked up in a regular garbage truck.  She was told that Clark Disposal “single streams” all recycling to the Adams County Recycling Center.

Business:

A)   Bruce Holsclaw of Juneau County Emergency Management spoke to the Board about the county’s update of the All Hazard Mitigation Plan.  A draft copy of the plan will be made available for public inspection and comments this Fall.  The plan promotes advance planning and preparation to prevent emergency situations when possible.
 

B)   The 2009 Town Budget was amended to deduct $26,523 from the Capital Improvement Reserve.  This amount was expected to be received from a FCL withdrawal but the transaction was cancelled by the owner.  Motion by Franek, second by Schneider; carried by a voice vote of 3 ayes.
 

C)   The proposed amendment to Ord. No. 19 banning the use of semi-trailers/shipping containers as an accessory building, storage building or living unit, was reviewed and approved by the town attorney.  Motion by Singer to take steps necessary to adopt the amendment at the September meeting, second by Franek; carried by a voice vote of 3 ayes.  The clerk will publish notice of the amendment as required.

D)  Dave Singer reported that Lyndon Town is having a problem with screen houses and garages being used as residences.  Lyndon is in the process of creating an ordinance to prevent the building of a garage or accessory building before a house is on the parcel. Supervisor Singer believes Kildare should also have an ordinance banning placement of a garage on a property before a residence.  After discussion, it was decided that rather than a new ordinance, our current ordinances should be reviewed and language added to address such situations.  A review committee will be appointed later this Fall.

E) The clerk requested $75 to purchase training materials for the 2010-2011 election inspectors.  Motion by Singer, second by Schneider; carried by a voice vote of 3 ayes.

F)  Ideas and concerns about a seasonal town cleanup were discussed.  It was decided that information will be compiled and sent out with the property tax bills and annual newsletter.

G)  Chairman Franek spoke with Sheriff Brent Oleson about ATV law violators in the town.  The Sheriff promised to provide more patrols.  Franek will also push to replace ATV route signs that have been disappearing.

Building permit applications were submitted by Peter Nowobilski for a chicken coop on 24th Ave; Eric Lewandowski for a garage on Cty Rd N; Witold Szawlowski for a deck addition on 28th Ave; Brenda Engevold for a porch addition on McMahon Rd and Kazimierz & Helen Czaja for a wood shed on Evergreen Ln.  A Driveway request was submitted by Terry and Mary Driscoll on Buffalo Trail. Motion by Schneider to approve all applications; second by Franek; carried by a voice vote of 3 ayes.

Motion by Franek to pay all bills on the table; second by Schneider; carried by a voice vote of 3 ayes.

Items for the September agenda: Amendment to Ord. No 19, and an ATV update.

Motion by Schneider to adjourn; second by Franek; carried by a voice vote of 3 ayes. Meeting adjourned at 8:46 p.m.
